Complimentary Case Consultation Prior to undertaking the legal defense of any client, I evaluate each case to determine its procedural posture and appropriate flat fee. Complimentary case consultations are done via video conference calls. My flat fees vary with the specifics of each case but, generally speaking, each phase of an SPB case entails the following:
Appeal and Settlement Conference ($5000) Client onboarding and conflicts check; review of the Notice of Adverse Action and “Skelly Packet”, Rejection During Probation, or any other action triggering SPB jurisdiction; filing of the SPB Appeal; identification of prudent legal defenses; consultation with percipient and character witnesses; preparation and filing of the Prehearing Settlement Conference Statement; appearance at the Settlement Conference Hearing; consultation and advice regarding settlement offers; and resolution of the case by stipulation or setting the case for evidentiary hearing.
Evidentiary Hearing Preparation ($7500) If the case does not settle, prepare client for evidentiary hearing and rigorous examination under oath; issue subpoenas and draft examination outlines for all necessary defense witnesses; file appropriate pretrial motions; continue efforts to settle the case before hearing; appear at evidentiary hearing and present evidence and argument, preserving all relevant appealable issues.
Evidentiary Hearing ($2500 per day)
Writs of Mandate and Appeals Appealing a clearly erroneous SPB Decision might be in order. The flat fees for writ petitions and appeals are determined on a case-by-case basis.
